ok, so I get a phone call a little bit ago...

My friend got pulled over going 138mph in a 65 zone on a GSX-R 600... Hes 21 in the Us Army, just got a Article 15(very bad) for drinking ONE beer on his lunch break at hotters. Basiclly the cop and others boxed him in and have him a wreckless driving ticket with intention to kill. His past driving record has been 3 wreckless tickets and 1 normal speeding ticket, I think his career is over. I had to get him and his bike just now or it would of been impounded.

I was just thinking he may get jail time, huge fine, lic take away forever on his motorcyle, and lic suspended for a year. With jail time depends how hard the judge will lay it to him, Article 19 (or something like thaT?) which means going AWOL, Apsent with out taking proper leave time, than a honable discharge.

Any military folk on here? What do you think my will happen?

Not sure how the Army is right now for booting people out but in the USAF he'd be gone at the end of his enlistment.

We're in what some people call a one mistake Air Force right now. They're just itching to boot people out that can't behave themselves/cast the military in a bad light.

He sounds like he passed his one big mistake a long time ago. But, like I said, I'm not sure how the Army's handling these things right now. They might just send him to Afghanistan or Iraq where he can't drink or ride his motorcycle for a few months to see if he straightens his *** out or not. :rolleyes:

If he did all this while in the service he could be facing a bad conduct discharge after they make him do civilian jail time. Doing twice the speed limit is not a smart thing Army or not. He is lucky to be alive. It will be almost impossible to get a job with a security clearance now.

What a lot of young military people don't realize until it's too late is that what you do on your personal time will reflect back into your military job.

He probably will be discharged with either a bad conduct or worse, a dishonorable discharge. I'd say bad conduct but that's my guess.

Like Lefty pretty much said. It's called Double Jeopardy.

3x prior reckless driving tickets plus 1x speeding? :eek:

1x reckless on your record is bad enough..but 3x? Wow...No disrespect to you...knowing he's your friend 'n all..but it's time something like this happened to wake him up...before something else worse happened. I'm no angel either when it comes to driving, and getting tickets in my youth..but 3x reckless tickets..he's driving like crazy all the time. You only get so many "shots across the bow" before something big happens. :nod:

Alright, if the guy is a good Soldier he stands some kind of chance to remain in the army. During these times its hard to be booted out. In my unit we have a Soldier who is trying to get kicked out, we are trying to get him out and he is still in. Point being, its tough to be booted.

As i said if he is a good Soldier he stands a fighting chance.... although they can affect his career. The military may keep him, bust him down to private, give him an Article 15, take his pay. Pretty much he will still be in, but he'll owe a lot to Uncle Sam.
Now on the other hand the simple way to put it, he could be getting the boot with a DIShonorable discharge. That will ruin getting a job anywhere, flippin burgers or executive.

Too many other factors to tell you what will happen but im thinking the first situation is what your looking at

You want me to talk some sense into him? I’m serious too, I’ll PM you my cell number.

Here’s some background, I joined the Army on the delayed entry program when I was in high school, I was on the back of a friend’s bike when we hit a pickup truck head on. Two major bone surgeries and the end of any chance of military duty. I tried to join the Army again about six years later and they still wouldn’t accept me.

Did I stop riding bikes? Hell no, that would have been too easy. Around the early 90’s I was in a street racing accident where I flew of the bike much faster then he was going.

I’ll explain to him what it’s like too have a doctor yank your broken foot back into place, it’s a little painful to say the least. Also what it like to have your skin ground down to the bone from the asphalt, and to lay in traction with plastic tubes sticking in body parts that were never meant for things like that. If you ever want to experience pain, try being strapped down to a bed because you are threatening to kill a mutherf**ker, and all they are trying to help you, too bad they are holding a brush and are scrubbing rocks and dirt from your road rash. To this day I'll pop a little zit on my arm or hand only to find out it's a tiny piece of rock or gravel.

Did I stop riding bikes? Hell no, that would too easy, but I sure did slow down a lot.

I hate to single you out, seem like a cool guy to me but before you judge a man can you honestly tell me that with all the partying and playing around that you do, that you have never done something stupid or have NEVER gotten behind the wheel of a car after drinking?

In my 32 years or so of riding bikes, I have done it twice. Even though drinking and getting on my bike was something that I said I would never do. Funny thing is I also only have had one ticket ever while riding a bike, got caught for 62 in a 55.

I wish we lived in a world where we used our better judgment all the time but we don’t. I wouldn’t wish being splat on side the road on my worst enemy.

I used to ride bikes, but would never do that speed on a public highway. Also, as a member of the military he should know that what he does on his time has consequences to his military career. Not many things short of being convicted on of a serious felony will affect my career. These are the differences. I have ever driven drunk..yes only 1 or 2 times EVER. Would I do it on a cyle? Hell NO.

I've done it twice, once on New Years Eve I decided to take a ride after I caught a buzz, the kids used me for a bottle rocket target so I made it around the block and parked my bike back in the garage. The second time was after riding about 600 miles my wife and I stopped and had a drink and then road the rest of the 100 miles back home.

Like I mentioned I wish we always used our better judgment, but we don’t. Those who do are often nominated for Sainthood, and I don’t see any candidates around here.

Sorry to hear this, at least he isn't dead though. Personally i hope they kick him out. If he can't be trusted with a bike, how can he be trusted with his job. How many peoples lives could be in his hands?

As far as what kind of discharge. Hopefully for his futures sake it won't be a dishonorable, but i can't say he doesn't deserve it....

If the cops had to box him into anything... to pull him over. he clearly has everything (including the article 15) coming to him. Had he pulled over right away and owned up to his speeding, in might be a different story. But since he had three prior related driving hits on his military record, and most likely these are drinking related. He's gonna get slammed hard by a military judge. I know he's heard the anti drinking verbiage from since basic trainging from his chain of command at least on a yearly basis (to include the holiday weekends) and has disregarded these warnings. he's gonna be walking funny for this one.

The AWOL thing is alarming. Clearly he was not where he was suppose to be and had left his post without being released from duty. The Army would not put this on the table unless, there is a lot more to this story then he's telling you. If he told you all this from jail... It's possibly true. He would not be out on the street today if he was charged with being AWOL. This is huge in the military.

If everything he told you is true. He is clearly looking at some jail time. At the very very BEST... he will be released from duty at the end of his enlistment. I hope he has a good lawyer. Maybe he can plea to restricted duty to post (six months to a year). When his enlistment is up he need to get out of the Army. This way he may have a chance at a good conduct discharge at the end of his hitch.

I would not hold my breath though. It's all up to his Commander, if he's offered an article 15 he'd be foolish not to take it. The military only asks you to obey the law, be professional and behave in public. Tell him to grow the hell up and do as he's told.

His court date is Aug 2nd, ill keep everyone posted

he is on base now, locked down, and going community service on the weekends at his Lawyer request.

Did he get all the wreckless driving convictions during active duty? Without knowing his entire military record I can't comment on the outcome, but a dishonorable discharge is very unlikely for these charges. With 1 NJP already in the books, he may be considered a "$hitbird" by military leaders and if they really want him gone he could certainly get the boot right away or likely denied re-enlistment if he had any inclination to do so. The local authorities work with the military and the chance of becoming AWOL while serving a sentence off base in also unlikely.

i had a 140 in 65 dui felony fleeing (which i was not just drunk and not paying attention) and i had to spend about 8000 to stay out of the pokey ... he will need a GOOD lawyer
