I doubt sueing will be worth it. Are you saying that you modem loses synch and the lights on it start flashing?? If so, then you may have a weak line. Did they test your cable line when they installed it or did you do a self-install kit?

Well, I kind of doubt that suing will be worth it. I would document the problem the best you can, keep on @Home to fix your problem by having them inspect your lines - replace your modem - replace your NIC card, etc. On top of everything else, be sure to request a credit for lost service time. I got 2 weeks credit on the current bill just by requesting it firmly BUT politely.
I had the same problems you describe and was on the phone w/tech support just about everyday and made sure that I kept them aware of the problem. Get a problem number, be polite but strong-willed, and document-document-document every instance of a problem and the conditions prior to the problem.
My problem was solved by the simple replacement of my NIC card but it took my constant barrage of complaints to get them to try that. @Home apparently hates to replace NIC cards and only does that as a last resort. After reading other posts, I made sure to specifically request an Intel or 3COM based NIC card rather than the normal D-Link I had originally.
The problem could also be with your computer, after all. Did you attempt to reformat/reinstall everything again just in case that you had a corrupted entry somewhere. You may want to try a registry cleaner such as EasyCleaner http://www.saunalahti.fi/tonihele/ecleane.htm
I used it to clean my registry and as a pleasant plus, it improved my boot up time dramatically. I was surprised that I had so much garbage left in my registry and I had even gone through my registry and cleaned it manually a number of times.
Anyway, try requesting a new NIC card to start with and see if that doesn't help.

funny thing is that everything is fine
the modem lights area as usual, just not responding or anything to pings and such
it does still flicker (attempt to contact the gateway or something??)it couldn't be hardware bcos i can renew he connection by renewing ip (mine is dhcp and not static)
could there be any software problem? or is @home made a huge mistake and endorsed someone else with my ip and when he turned on his machine, boom, major conflict and when i renew the ip mine goes back on?
also, i htink its pretty dangerous tweaking with the registry. prob still persists
is ndis 5.0 driver a generic driver which is okay?
i want to d/l stuff from slow servers!!!
not to mention @home is already slow for cable

You'd lose horribly if you even attempted to sue them anyways.
