Man Loses Top Of His Head In Brain Operation

Wed Aug 29, 2007 11:08AM EDT

BERLIN (Reuters) - A German court has awarded 3,000 euros ($4,100) in damages to a man who had to have the top of his skull replaced with plastic because of a faulty hospital fridge.

Doctors removed the top of the man's head and put it in cold storage while they operated on his brain, the court in the western city of Koblenz said Tuesday.

Because the refrigerator was defective, the section of skull was not kept cool enough and could not be reattached. Doctors replaced the bone with a plastic prosthesis.

The man sought compensation of at least 20,000 euros on the grounds that the prosthesis caused him headaches, affected his balance and made him unduly sensitivity to the weather.

Following consultations with experts, the court found that the operation had caused the man's discomfort, not the loss of the top of his skull.

Compensation of 3,000 euros was "appropriate and sufficient," it said.

"The experts consulted by the court concluded the new skull roof was better than the original," a court spokesman said.

Anyone in the US would be a millionaire for the same mistake. $4,100 is ridiculous!

Yep if that were here they would be naming the hospital after that person now, since they would now own it to go along with the millions they would get as well. I think we go overboard here on lawsuits. But in this persons case, I think he was shafted.

This is the first case I’ve ever heard of where a man got paid for not getting head.

Seriously, I wish juries in the US would take the hint and not give out such outrageous settlements also. People don’t seem to realize that all it is doing is driving up the cost of everything from healthcare to a simple household ladder.

Oh that is bullshit. They didn't keep his dome on ice and it was ruined. THE DOCS caused him to need a plastic cranium. If I woke up and had a a 'Ronco'(TM) skullcap rather than my OEM dome I would rather ticked off.

Also...."BETTER"? Whiskey Tango Foxtrot? BETTER?!?!? Yeah seeing as how plastic grows a luxurious head of hair, has many vessels embedded into it for cooling/heating purposes. Also the lack of sensory apparatus(nerves) will make it very easy for trauma to occur. This poor guy won't have a clue if the hot sun is baking his brain.

Tho, stabbing a knife into yer head at parties might be a nifty trick.

A secretary making hundreds of thousands for carpal tunnel? Stupid.

A few hundred thou for losing the top of your noggin? Fully justified.

This guy was shafted, plain and simple.
