I would get the latest bios off the manufacturer website and install that before you send it back. I had a P5ND which I thought was defective because it kept crashing with my 8800GT but it ended up being some bios issues that was causing it to malfunction.

#1 definitely could be a factor. #2 is not since it is a newer motherboard and I have checked their site already for an update. At this point I have sent it in and will be getting it either fixed or replaced (they haven't said which). When I get it back I can let you know how it's going.
