So ...should I do this?

I have a guy that is hiding a vehicle and has moved out of his mommies house...although I think this is a lie. I normally like to play by the rules of the game so to speak but this particular account is really bugging me. I need to have him served papers for a lawsuit I'm filing against him but so far he's proven to be evasive. I do have one option that seems fool proof but it's legality is in the grey area. He cleans houses for a living .... all I need to do is make an appointment or call his ad for an estimate and he's done. I spoke with our attorney about this and she says go ahead but the fact our normal process server won't do this leaves me wondering.
So where is the best place to turn ?....Speedguide of course!
Your thoughts?

I don't think that's out of bounds. If they guy is hiding what's the problem with using a phonecall to find him.

Cuz the process server has taken heat in the past ..............I gotta pretend i'm a customer......entrapment..
I mean the guy is basically stealing a car. I'm inclined to just do it but the the VP is also waivering.

Well if the popo can send out fake lottery notices to people with warrants...
If your attorney says ok, i'd do it. But make sure you get it ok'd with the boss so if the s hits the fan you can pass the buck.

a process server using entrapment??? It happens all the time, that's how they get the papers served. I've seen them act like pizza delivery guys, etc. I've seen some very very creative process severs. Serve him papers anyway you can.

So did they wait until you ordered a pizza, or just show up with a pizza at a random time

I asked the same thing ..the response I got was just a bunch of legal babble... he doesn't have a warrant blah blah...
I think I'll just do it and let the attorney work it out.

that's what I thought too ...I mean i usually just pass it on and it's done... I didn't know they grew a conscience.....my normal service won't do it.

I had a hangover and didn't want to be on Cops until I looked/felt better

Make an appointment to have him clean the Credit Union, if he comes in serve him the papers

and make sure he does a good job on the windows. That way its not entrapment. Some peeps are that stupid for the almighty dollar.

No way he'd show here ..he'd know but hell yeah I thought of that....I'd love to serve him then tell him to clean my mother in laws house...

I thought it was only entrapment you set the person up to commit a crime they ordinarily would not have committed?

I have no idea .... i'm only going with what i've been told by our lawyer.....that our normal process server won't do it. This was the first option that came to mind so to cover my ass I ran it through her first and this whole situation came up...I mean if she says it's ok I think i'm gonna do it but I gotta figure out who's gonna be the bait

I don't think getting papers served on you means you were entrapped. Now if you set him up to steal another car.....

I would be careful setting that up with anyone personal, if the guys is vindictive he could try to get even. I dont know how you feel about your MIL but he would have the address and could try and harrass her/them.

I know its your job and all but at one time i fell behind on my payments and had a collector come and threaten to take my car, which I had already made 3 of the 5 years of payments plus a large down payment and I did the same thing. I wasn't about to let them come and just take the car after I made all those payments just because I fell behind. Needless to say I caught up and finally paid it off. If he only has a couple of months worth of payments and no down payment I'd say to hang the guy, but if he has always made payments and is hitting on hard times I'd give the guy a break. It might be his and his families only means of getting income right now, especially if he's cleaning offices.

I've already repo'd him once and given it back after he redeemed ...this is round 2 for him. I will show him no mercy this time. I give 2nd and 3rd chances at times but he doesn't deserve it this time.

What's his MO? Is he just struggling, or is he hitting the pipe, while cleaning out houses?

Have someone you know schedule a cleaning....just *happen by* when the deadbeat shows up. Coincidence happens ya know? Layer the sting by using a friend of a friend or something.
