Seriously though, if I wanted to sell an empty box why should I not be allowed to?

If someone is willing to give me $1000 for an empty box, hells yeah I'm gonna take it, I just provided something someone wanted and they paid me for it.

I don't see the problem with that. That's the way the world works, people sell things to people that want things and they pay you for it. The value and worth of an empty box to me may be different to someone else. Perhaps someone is collecting console boxes, who knows, the value to them of that empty box is different then what you think, but that's ok.

It was clearly printed that it was an empty box in the description and the title.

The problem with that is "false advertising", Which is by the way against the law. You can't have pictures of Xbox's and games up, and then in small print somewhere say "this is only a box". Someone can actually sue.

A question for the people that are defending the asshat. When the buyer gets the item, and isn't happy and wants a refund. What do you do?

Also, I saw the full item description yesterday. It is much larger than image that is posted in this thread, anybody have a full auction page?

Read it again, it isn't false advertising. In the title itself it says in all caps "BOX ONLY". In the first line of the description it says "This is the premium bundle box only". And throughout those first few lines in the description it repeatedly says it is the box only.

It's clearly stated that it is the box only so how can that be false advertising.

Give me proof that it is false advertising.

I can agree on the system specs, that didn't need to be posted since it is an empty box.

But the rest I see no problem with, it clearly states in the title and description that it is the box only.

Does ebay have a mandatory refund policy? If not I'd offer to buy them a "Reading for Dummies" book, not even charge them shipping.

Well with phishing if you look in the corner of your browser you can see if the page your looking at is actually the page that is being shown. If its made to look exactly like an Ebay page but its actually a site in Russia designed to capture your username and password. Its the same exact thing! Its a page thts designed to confuse and manipulate a person and to take their money.
Its the same thing in that it targets a person that doesn't know. The same way with Adware.

That box has about as much collectable value as the corn in my crap. It has no collectible value unless its some sort of special edition.

Ok well 58.00 bucks isn't too bad but 400.00 is ridiculous. For 58 bucks they can get the box and give it as a promissory present or something. I still don't get what the need for putting the system specs in are for.

Phishing is more severe that that auction, I think you agree with that even.

As for value, gamers are crazy there was a guy at gamestop wanting to get a copy of FEAR when they got a new shipment i so he coudl get it before it was touched by the slaes people. People collect gameboy games too. Maybe someone would want a box because theirs got ripped. There are tons of possibilities.

Ok it's not nearly as bad as $400, but $58 for a brown box that says X-box on it is pretty messed up nonetheless. Since the buyer had a 0 I am guessing the sale probably didn't actually happen.

Stealing personal info

With this it was a sale, the buyer chose to buy the box, he didnt surf into a fake site and automatically have a bid thrown in for it without his permission.

With phishing the action is theft. There is no sale.

contact the seller, see if he will accept a return, if not, count your chickens and move on, no one forces you to buy anything off ebay, you voluntarily bid on the item and put forth the money to buy an item, if you decide you really don't want it you have to contact the person who sold it to you, it is between you and him

I've given them a full refund for a past purchase. The buyer thought it was a different model and even though it was his mistake I gave him a full refund less the shipping.

Don't blame the seller because the buyer didn't read what he was actually buying.
