If you're really trying to run that at 1600 x 1200 85hz the only thing I can think of is that the resolution settings are set wrong in game ...I think it might have trouble with the refresh rate *shrug*

locate the video.con file and open it with notepad and edit it to the desired refresh rate and resolution....I believe it's within My Documents.

yep located the file in my docs and I found that the resolution was at 800x600 @60hz refesh rate. I changed my desktop settings to this setting but the game still crashes

you mentioned updating your video card....have you downloaded the latest drivers for the 9800? ..also match the file settings to your desktop/monitor settings.

it should run on it ....the only thing I can think of is to keep fiddling with the resolution and refresh rates or uninstall the driver ...use a driver cleaner and reinstall.
