can mem be in bank 1 and 3 and skip 2, since the Heat spreaders are near touching, so i wanna give them as much room as possible... i have 2 sticks and 3 banks.

Should have a look in your mobo manual to be sure, but I believe they'll work.

Best to have ram in the first slots available though.

yes you'll be fine.. infact that is better..because on some mobos the ram slots use different power channels..so if u OC, you MAY get slightly better results

actually they're no OC'd actually running below spec... But i wont lose any performance spreading them?

I doubt there will be any performance loss, and if there is it will be so slight you won't notice it. A millisecond or so to switch banks, that's all.
It's gotta switch banks after the first slot is used up anyway even if you use the second slot.
