to make a long story short, I'm a new Earthlink DSL subscriber. I actually thought that I would be able to at least reach 60% to 75% of the maximum speeds they purport I can reach, that is given variables like 'peak hours' and such. Earthlink claimed 1.5mbps downstream, and 256kbps upstream. From research on this site zdnet, dslreports, as well as a few others, I know that speeds can't be guaranteed. However, it seems that most folks connect at 60% to 75% of their ISP's purported maximum speeds. The problem is I could never have reached what Earthlink told me I would be able to reach, because I have a 640/90 DSL line. I'm capped. The explanation Earthlink service support gave was that it is because of vendor constraints. I wish they would have shared this very vital information with me before I agreed to the freak'n 6month contract. The said the Genuity, alias Verizon is the vendor for my phone line. At the same time the Earthlink support person said the maximum I can get is 786kbps/128kbps. Well, why don't they upcapp me soes that I can reach that. I could have went with Verizon's DSL service months ago. I went with Earthlink because I thought they offered more 'bang for your buck' Is there any way to find out if there is another vendor GSP in my area. Because Earthlink advertised that they look for the best vendors possible to provide a 1.5mbps/256kbps 'best effort' service. Isn't this false advertisement. Those slithery fr@@$@!?@# snakes!!!

Please help what should I do or what can I do?

oh yeah since I'm stuck with a Earthlink-Genuity-Verizon 640/90 service here are my settings from TCP/IP analyzer:
