Facebook sued over alleged private message 'scanning'

Facebook is facing a lawsuit over allegations that it monitors users' private messages. The lawsuit filed earlier this week alleges that Facebook scans messages between users labeled "private" for links and other information that can be sold to advertisers, marketers and data aggregators. When a user shares a link within a Facebook message, these links are recorded to contribute to the brand's Facebook activity, and can add to the amount of 'likes' a firm has.

The practice compromises privacy and undermines Facebook's promise of "unprecedented" security options for its messaging function, two Facebook users said in the complaint filed in federal court in San Jose, California.

The lawsuit asks for class-action status, an injunction against Facebook's practices and damages from the company to class members. It claims the greater of either $100 a day for each day of alleged violation or $10,000, for each user claimed to be affected, besides damages under California law.

Facebook has faced criticism for its privacy policies in the past. Last year, Facebook came under fire for revised changes to its privacy policy which would allow adverts to be created using the profile pictures and names of the site's users. Facebook argued that the proposal was little more than a clarification of its privacy policy, rather than a material change.
